General Provisions
1.1 This Offer is an official proposal of the online store "coine.com.ua", hereinafter referred to as the "Seller", to conclude a Distance Product Purchase and Sale Agreement, i.e., through the Online Store, hereinafter referred to as the "Agreement", and places this Public Offer (proposal) on the Seller's official website "https://coine.com.ua" (hereinafter referred to as the "Website").
1.2 The moment of full and unconditional acceptance of the Seller's proposal by the Buyer (acceptance) to conclude an electronic product purchase and sale agreement is considered to be the fact of payment by the Buyer for the order under the terms of this Agreement, within the timeframes and at the prices indicated on the Seller's Website.
Terms and Definitions
2.1 In this Offer, unless the context otherwise requires, the following terms shall have the meanings specified below:
* "Product" - models, accessories, components, and accompanying items;
* "Online Store" - in accordance with the Law of Ukraine "On Electronic Commerce", a tool for presenting or selling a product, work, or service by entering into an electronic transaction.
* "Seller" - the company that sells the products presented on the Website.
* "Buyer" - an individual who has entered into an Agreement with the Seller under the conditions set forth below.
* "Order" - the selection of individual items from the list of products specified by the Buyer when placing an order and making a payment.
Subject of the Agreement
3.1 The Seller undertakes to transfer ownership of the Product to the Buyer, and the Buyer undertakes to pay for and accept the Product under the terms of this Agreement. This Agreement regulates the purchase and sale of products in the Online Store, including:
- voluntary selection of products by the Buyer in the Online Store;
- self-placed order by the Buyer in the Online Store;
- payment by the Buyer for the order placed in the Online Store;
- processing and delivery of the order to the Buyer's ownership under the terms of this Agreement.
Order Placement Procedure
4.1 The Buyer has the right to place an order for any product presented on the Website of the Online Store, provided it is in stock.
4.2 Each item may be represented in the order in any quantity.
4.3 In the absence of the product in stock, the Company Manager is obliged to inform the Buyer (by phone or via email).
4.4 In the absence of the product, the Buyer has the right to replace it with a product of an similar model, refuse this product, or cancel the order.
Order Payment Procedure
5.1. Online card payment.
Pay for the order from your Visa or MasterCard on our website immediately after placing the order. Payment takes place on a page secured by safety certificates. You only pay the cost of the product; no commission is charged for online payments. Please ensure that your card has an active permission for internet payments.
5.2. Payment to a PrivatBank card.
Pay for the order from your card to our PrivatBank card immediately after placing the order. The commission amount depends on the tariffs of your bank.
5.3. To a bank account.
The Buyer pays for the order within 1 business day by bank transfer of funds to the SELLER'S current account specified in the invoice, including via Internet banking.
5.4. If the funds are not received, the Online Store reserves the right to cancel the order.
Order Delivery Terms
6.1 Delivery of products purchased in the Online Store is carried out to the warehouses of transport companies, where the orders are issued.
6.2 Along with the order, the Buyer is provided with documents in accordance with the legislation of Ukraine.
Rights and Obligations of the Parties:
7.1 The Seller has the right to:
- unilaterally suspend the provision of services under this Agreement in case of breach of the terms of this Agreement by the Buyer.
7.2 The Buyer is obliged to:
- timely pay for and receive the order under the terms of this Agreement.
7.3 The Buyer has the right to:
- place an order in the Online Store;
- formalize an electronic agreement;
- demand fulfillment of the terms of this Agreement from the Seller.
Liability of the Parties
8.1 The Parties shall be liable for non-fulfillment or improper fulfillment of the terms of this Agreement in the manner prescribed by this Agreement and the current legislation of Ukraine.
8.2 The Seller is not liable for:
- minor discrepancies in the color scheme of the product, which may differ from the original product solely due to the different color rendering of personal computer monitors of specific models;
- the content and veracity of the information provided by the Buyer when placing the order;
- delays and interruptions in the provision of Services (order processing and product delivery) that occur for reasons beyond its control;
- illegal or unlawful actions committed by the Buyer using this access to the Internet;
- the transfer by the Buyer of their network identifiers - IP, MAC address, login, and password to third parties;
8.3 The Buyer, using the provided access to the Internet, is independently liable for harm caused by their actions (personally, even if another person was under their login) to individuals or their property, legal entities, the state, or moral principles of ethics.
8.4 In the event of force majeure circumstances, the Parties are exempted from fulfilling the terms of this Agreement. For the purposes of this Agreement, force majeure circumstances mean events of an extraordinary, unpredictable nature that exclude or objectively prevent the fulfillment of this Agreement, the occurrence of which the Parties could not foresee and prevent by reasonable means.
8.5 The Parties shall make maximum efforts to resolve any disputes exclusively through negotiations.
Other Conditions
9.1 The Online Store reserves the right to unilaterally amend this Agreement, provided that it is previously published on the website https://coine.com.ua.
9.2. The Online Store is created to organize a distance method of selling products via the Internet.
9.3 The Buyer is liable for the accuracy of the information specified when placing the order. At the same time, upon acceptance (placing an order and subsequent payment for the product), the Buyer gives the Seller their unconditional consent to the collection, processing, storage, and use of their personal data, within the meaning of the Law of Ukraine "On Protection of Personal Data".
9.4 Payment by the Buyer for an order placed in the Online Store means the Buyer's full agreement with the terms of the purchase and sale agreement (public offer).
9.5 The actual date of the electronic transaction between the Parties is the date of acceptance of the terms, in accordance with Art. 11 of the Law of Ukraine "On Electronic Commerce".
9.6 Use of the Online Store resource for previewing products, as well as for placing an order, is free of charge for the Buyer.
9.7 The information provided by the Buyer is confidential. The Online Store uses information about the Buyer solely for the purpose of processing the order, sending notifications to the Buyer, delivering the product, performing mutual settlements, etc.
Procedure for Returning Goods of Proper Quality
10.1 The return of products to the Online Store is carried out in accordance with the current legislation of Ukraine.
10.2 The return of products to the Online Store is carried out at the expense of the Buyer.
10.3 When the Buyer returns a product of proper quality, the Online Store returns the amount paid for the product upon the actual return of the product, less compensation for the Online Store's expenses related to the delivery of the product to the Buyer.
Terms and Rules for Refunds
11.1 Exchange or return of goods is carried out within two weeks (14 days).
11.2 The returned product must be of merchantable quality (show no signs of use).
11.3. If the returned product was paid for online, the refund is made to the card from which the prepayment was made.
11.4 Crediting of funds to the card is carried out within 1-5 business days.
Term of the Agreement
12.1 An electronic agreement is considered concluded from the moment the person who sent the proposal to conclude such an agreement receives a response accepting this proposal in the manner defined by part seven of Article 11 of the Law of Ukraine "On Electronic Commerce".
12.2 Before the expiration of its term, this Agreement may be terminated by mutual consent of the Parties prior to the actual delivery of the product, by way of a refund.
12.3 The Parties have the right to terminate this Agreement unilaterally in case of non-fulfillment of the terms of this Agreement by one of the Parties and in cases provided for by the current legislation of Ukraine.
Please note that the online store "coine.com.ua" on the official website https://coine.com.ua has the right, in accordance with the legislation of Ukraine, to grant the right to use the internet platform to Sole Proprietors (FOP) and legal entities for the purpose of selling products.
